Limited Warranty

MEN warrants that each hardware product delivered under this warranty will be free from defects in material or workmanship and will conform to MEN's applicable specifications. If products sold hereunder are not as warranted, MEN shall, at its option, refund the purchase price or repair or replace the nonconforming products, as set forth below, provided proof of purchase and written notice of nonconformance is received by MEN within the applicable warranty period. All applicable products, including internally installed devices, and selected board products carry a warranty term of two (2) years from the date of shipment. The warranty period begins on the date of shipment from MEN's applicable facility. If a product is repaired or replaced under the warranty, the warranty on repair is 6 months.

Warranty Exclusions

The warranties set forth above do not extend to altered products that are repaired or maintained by other than personnel that MEN has trained and certified. They also do not apply to products that fail or are damaged due to shipment, handling or storage or operation, use or maintenance in a manner or environment that does not conform to MEN's published instructions and specifications. Batteries, failures due to batteries, magnetic tape heads and moving parts are also excluded.

Disclaimer of Other Warranties

This warranty is in lieu of all other warranties whether express, implied, or statutory. To the extent applicable, specifically excluded are any implied warranties arising by operation of law, custom or usage, including without limitation, the implied warranties of merchantability and fitness for a particular purpose or use. In no event shall MEN be liable for more than the contract price for the products in question. If buyer does not notify MEN in writing within the foregoing warranty period, MEN shall have no liability or obligation to buyer hereunder.
